It must be as simple as this:

If the channel does nada, zilch, ingenting, nothing bad to children — regardless of how it has been set, it has nothing whatsoever to fear.

Well I can not imagine a western country court judging a multimedia creator to a sentence where there is no crime. If the crime consists of YouTube advertising YouTube is the guilty party. And there will be a fair settlement.

If you were to drive your car on a new road, where the workers who built the road never got paid, nobody can blame you for it as this wasn't something you could ever know or control.

There will never be common sense. Too many people with too many opinions. So one persons definition of common sense is completely different to another. Some people watch TV shows about pregnant teens. My common sense is that that should never happen.

The marching band is safe from the FTC since they can't have their own YT channel, according to my source.

My (perhaps naive) hope is that my super-low-traffic, not monetized channel will be of little interest to these shadowy forces I don't even understand, and I've therefore been ignoring the whole thing.

Still, I can't help but ponder the strategy of things: Should I just mark my whole channel as of potential interest to children, thus protecting them from unintended (by me) targeted advertising, and at the same time protecting me from million$ in potential legal troubles? If the downside of that for my channel is less exposure, that's not really going to hurt me, my exposure is already near zero...

You know those so called creators who reposts old clips from family videos etc about funny cats etc? I can imagine those are at risk, can also imagine some of them making profit on that stuff. That will decrease enormously. And that's actually good because making money that way is quite fishy anyway.

Don't be so sure. I have a friend who has a surname which happens to exactly match the name of a very famous Disney character. He registered the domain "thatnameonline.com" and posted a few pics and blog type things about himself. He did not use any Disney images or styles or anything but he ended up with a legal letter from Disney. He ignored it and got another letter. This time he responded, basically saying "It's my surname and I'm not using any of your IP" and he added a disclaimer on his site too say that there was no connection with Disney. Then he got the third letter. Much more detailed, explaining how they will start proceedings against him if he does not take down the site. So he took down the site.

He had done nothing wrong but was facing possible legal action from a mega-corporation on a different continent. He has framed the letters but he is still bitter about it.

Kind of like Storj, but for streaming. Sounds like the future to me! :puf_smile:

Now, imagine if Storj added support for streaming and monitization.

I think the risk of falsified DMCA claims is still a much bigger threat to be honest. Also because people who file such claims can easily get away with being stupid while the content owner has to work pretty hard to correct things.

Sadly everything is bad on all fronts. If you are on your own (and no $$$$$) you are powerless. They can bleed you dry, even if you were right in the end. By then it's too late. The 'artists' have no choice to feed the Mouse, and be fed by the Mouse in return.

It's a mess.
